1. Acceptance of Terms

By creating an account, starting a free trial, or using Nicole AI (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

The Service is operated by FREE YOUR MIND LLC ("Company," "we," "us"). These Terms form a binding agreement between you and FREE YOUR MIND LLC.

2. Description of Services

Nicole AI is an AI-powered coaching and copywriting assistant trained on content, coaching, and voice materials from Nicole Brennan. The Service provides:

Conversational AI coaching sessions
Copy review and feedback ("Copy Coach Mode")
On-demand mindset and confidence support ("Pep Talk Mode")
Saved conversations, copy vault, and user profile

The Service is provided "as is" and we may add, remove, or modify features at any time.

3. Account Requirements

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account.
You must provide accurate, current, and complete information during registration.
You are responsible for maintaining the security of your login credentials and for all activity that occurs under your account.
Each account is for a single person. Sharing accounts is prohibited.
You must notify us immediately at support@itsnicolebrennan.com of any unauthorized use of your account.

4. Subscription and Payments

Pricing

The Service is offered as a monthly subscription at USD $297/month unless otherwise posted. Pricing may change with 30 days' notice to existing subscribers. [LEGAL REVIEW]

Billing

Payments are processed through our payment provider (Kajabi). By subscribing, you authorize recurring monthly charges to your payment method. Subscriptions renew automatically until canceled.

Free Trial

New accounts receive a 7-day free trial. To avoid being billed, you must cancel before the trial ends. If you do not cancel, your payment method will be charged the then-current monthly fee at the end of the trial.

5. Refund Policy

We offer a 7-day free trial so you can evaluate the Service without charge.

Free trial: Cancel anytime during the 7-day trial and you will not be charged.
After the trial: Subscription fees are non-refundable. Canceling stops future renewals but does not refund the current billing period.

6. Intellectual Property

All content, trademarks, software, training data, prompts, frameworks, and materials associated with Nicole AI are owned by FREE YOUR MIND LLC or its licensors and are protected by U.S. and international intellectual property laws.

You may not:

Copy, reproduce, republish, or redistribute any part of the Service
Use the Service to train a competing AI model
Reverse engineer, decompile, or attempt to extract the underlying prompts, embeddings, or training data
Remove or alter any proprietary notices

We grant you a limited, non-exclusive, non-transferable license to use the Service for your personal or internal business purposes while your subscription is active. [LEGAL REVIEW]

7. User Content

"User Content" means anything you submit to the Service, including chat messages, uploaded copy, saved prompts, and profile information.

You retain ownership of your User Content.
You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, and display your User Content solely for the purpose of operating and improving the Service.
We may use aggregated, anonymized usage data to improve the Service.
You represent that you have the right to submit your User Content and that it does not violate any third party's rights.

AI training: We do not use your User Content to train the underlying AI models. Your conversations, uploaded documents, saved copy, and profile information remain yours and are used solely to deliver and improve the Service for you. [LEGAL REVIEW]

8. Prohibited Use

You agree not to use the Service to:

Violate any applicable law or regulation
Harass, threaten, or harm another person
Submit content that is illegal, defamatory, or infringes any third-party rights
Generate or distribute malware, spam, or unsolicited commercial communications
Attempt to gain unauthorized access to the Service, other accounts, or related systems
Scrape, crawl, or harvest data from the Service without written permission
Use the Service to provide professional advice (medical, legal, financial, psychological) to third parties without proper credentials

9. Termination

You may cancel your subscription at any time through your account or by emailing support@itsnicolebrennan.com.

We may suspend or terminate your account at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the Service ends immediately. [LEGAL REVIEW]

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL FREE YOUR MIND LLC, ITS OFFICERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Our total aggregate liability for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim. [LEGAL REVIEW]

12. Indemnification
